For overseas enterprises stepping into China’s domestic marketplace, clarifying the legal definition of a trademark under Chinese jurisdiction stands as a foundational step to shield brand assets, governed primarily by the Trademark Law of the People’s Republic of China (2019 Revision) and its supporting Implementation Regulations (2020) issued by CNIPA (China National Intellectual Property Administration).

Per China’s Trademark Law, a trademark legally refers to any distinctive sign capable of distinguishing the goods or services of one business entity from competing counterparts. Registrable marks cover written words, graphic logos, letters, numerals, three-dimensional shapes, combined colour schemes, sound marks, or any blended combination of these elements. By contrast, signs lacking inherent distinctiveness, generic product names, or symbols conflicting with national sovereignty, public order as stipulated in Articles 10 and 11 are banned from trademark registration entirely.

Chinese legislation categorizes valid trademarks into four core classifications: 1) goods trademarks affixed to physical products, 2) service trademarks for commercial offerings such as retail or consulting, 3) collective trademarks registered by industrial associations for member enterprises’ shared use, and 4) certification marks that verify product origin or quality standards for third-party operators.

A pivotal legal distinction separates registered and unregistered trademarks in China’s first-to-file trademark regime. Only marks formally approved by CNIPA grant registrants exclusive nationwide proprietary rights to block identical or similar applications. Unregistered marks receive minimal legal safeguards, limited exclusively to well-known brands with proven prior market reputation under relevant provisions, leaving ordinary unregistered brands vulnerable to malicious pre-emptive registration by others.

Crucially, trademark protection is confined strictly to the approved mark and its designated product/services instead of automatic full-category coverage.

In short, securing trademark registration prior to Chinese market rollout remains the most reliable pathway for foreign firms to cement lawful brand exclusivity under China’s trademark regulatory system.
