How Overseas Entities Respond to Trademark Opposition in China
Under China’s effective Trademark Law and Implementing Regulations, foreign trademark applicants encountering post-publication opposition must follow standardized statutory steps strictly.
After receiving from CNIPA a notice of opposition with a full copy of opposition arguments and evidence, foreign applicants have a mandatory 30-calendar-day window to submit a formal written response upon receiving the official notice. Opposition respondents should compile supportive evidence including trademark design source documents, overseas prior-use records, brand popularity materials, or proof of the opponent’s malicious filing intent. Supplementary evidence can be added within three months after lodging the reply as legally permitted.
After evidence review, CNIPA issues a written decision. If the opposition succeeds and thus the registration gets disapproved, the foreign applicant may file a review application with CNIPA within 15 days of receiving the decision. Should the review still end unfavorably, administrative litigation can be initiated at Beijing IP Court within 30 days after receiving the review decision.
For cross-border procedural accuracy, entrusting a qualified local Chinese IP agent remains the prudent choice for overseas entities.
