Post-registration Trademark Compliance for Overseas Entities in China

Under China’s prevailing Trademark Law and its Implementing Regulations, overseas brand owners receive an official electronic registration certificate once their trademarks gain CNIPA approval. Each registered trademark enjoys an initial 10-year protection term calculated from the registration date.

To retain exclusive rights indefinitely, owners need regular trademark renewal. Applications can be filed within 12 months prior to expiry; a six-month post-expiry grace period is available yet subject to extra official fees. Every successful renewal extends protection for another decade starting the day after the prior term lapses, with no legal cap on total renewal rounds. All foreign registrants without domestic Chinese premises must retain a locally licensed IP agent to submit renewal paperwork.

Prompt recordal of changes to the registration information stands as another core maintenance duty per statutory rules. Any changes in the registrant’s legal name, registered address or appointed Chinese trademark agent require timely recordals filed with CNIPA. Delayed change recordals may create obstacles for subsequent renewal formalities.
