Do Overseas Entities Need Mandatory Trademark Agents for China Trademark Filing

When overseas enterprises or individual applicants expand into China’s market and file trademark registration, mandatory representation rules apply under China’s effective Trademark Law (revised 2019) and Implementing Regulations of the Trademark Law, with clear legal exceptions specified.

Article 18 of the prevailing Trademark Law draws a critical distinction between domestic and foreign applicants. While Chinese applicants may either submit applications independently or commission legally registered trademark agencies, foreigners and foreign businesses without habitual residence or established business premises inside China are legally required to retain duly qualified local trademark agents for all trademark-related formalities, including registration, assignment and opposition filings.

The Implementing Regulations further elaborate relevant procedural clauses in Article 5: appointed agents must submit formal power of attorney specifying representation scope and the applicant’s nationality.
