China’s Trademark Opposition Procedure: A Guide for Foreign Entities

China’s trademark opposition is a critical pre-registration challenge mechanism under the Trademark Law for foreign businesses entering the Chinese market. Administered by the China National Intellectual Property Administration (CNIPA), it allows right holders to block potentially infringing marks during a mandatory three-month publication period following preliminary approval. This deadline is strictly non-extendable, making timely monitoring essential.

Foreign entities with prior rights—such as registered trademarks, well-known brand status, trade names, or copyrights—can file oppositions when they discover identical or similar marks being applied for. Required materials include a formal application, clear legal grounds, solid evidence of prior rights  and proof of the applicant’s bad faith (if any). All documents must be in Chinese or accompanied by appropriate translations.

After filing, CNIPA notifies the applicant, who has 30 days to submit a response. The authority typically issues a decision within 12–18 months. If successful, the opposed mark is refused registration. The applicant may apply for review within 15 days after recieving the opposition decision, then pursue administrative litigation in Chinese courts.
